Premises Liability & TBI: When Unsafe Conditions Lead to Brain Injury
Premises liability cases often involve incidents such as slip-and-fall accidents or unsafe property conditions. While these events are frequently perceived as minor, they may result in traumatic brain injury (TBI) with significant neurological consequences.
From a neurological perspective, the severity of injury is not determined by the apparent nature of the incident, but by the forces transmitted to the brain.
A sudden fall can generate:
Acceleration–deceleration forces
Rotational movement
Impact-related energy transfer
These mechanisms may disrupt brain function—even in the absence of:
Direct head impact
Loss of consciousness
Visible external injury
Patients may present with symptoms such as:
Cognitive slowing
Memory impairment
Difficulty with attention and concentration
Headaches or dizziness
Balance disturbances
In many cases, standard imaging studies such as CT or MRI are normal. This reflects the limitations of these tools in detecting microscopic and functional brain injury, rather than the absence of neurological impairment.
From a medico-legal standpoint, premises liability cases involving TBI often require careful evaluation of causation.
The key question is not simply whether a fall occurred, but whether the mechanism of injury is consistent with the reported neurological findings.
Accurate analysis requires:
Assessment of the biomechanics of the incident
Evaluation of symptom onset and progression
Correlation with established neurological principles
Consideration of alternative explanations
Both underestimation and overestimation of injury may occur when these factors are not properly considered.
